HOW TO ENTER

To be eligible to enter, entrants must purchase a 3-pack of Up & Go from a participating Coles or BI-LO store during the promotional period. To enter, entrants must then send an SMS to 1994 6277 containing their full name and product barcode.

Premium SMS cost is 55c. Entrants must have premium service access.

CONDITIONS OF ENTRY

  1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.
  2. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Incomplete or indecipherable entries will be deemed invalid.
  5. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
  6. Entrants must retain their original Coles purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
  7. Winners will be required to send a copy of their winning original Coles receipt to the Promoter for verification purposes and in order to claim their prize. Winners will be ineligible to receive the prize if the Promoter does not receive the proof of purchase and the requested winner's details before the unclaimed prize draw.  The Promoter will notify winners of a reply paid address for this purpose.
  8. Premium SMS cost is 55c. Entrants must have premium service access. Major prize winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
  9. Promotion commences 12.00.01am AEDST on 01.11.2006. Final entries close at 5.30pm AEDST on 30.11.2006. All draws will take place at Suite 104/55 Beach Street, Port Melbourne, Vic 3207. Minor prize draws will take place every day between 01.11.2006 and 30.11.2006 inclusive at 9am, 10am, 11am, 12pm, 1pm, 2pm, 3pm, 4pm, 5pm and 6pm AEDST. Entries for each draw close 30 minutes prior to the relevant draw. Entries received after 5.30pm on each day (excluding 30.11.2006) will be entered into the following day's 9.00am draw. The major prize draw will take place on 06.12.2006 at 12pm AEDST.  All entries received will be entered into the corresponding minor prize draw and the major prize draw but will not roll over into subsequent minor draws. All winners will be notified by SMS and results will be published in The Australian on 28.11.06 and 18.12.2006. The Promoter's decision is final and no correspondence will be entered into.
  10. The first valid entry drawn in each minor draw will win 100 song downloads from iTunes valued at $169.
  11. The first 3 valid entries drawn in the major prize draw will each win an Ipod HiFi pack which includes an Ipod 30GB valued at $449, an Ipod Hi-Fi valued at $519 and 100 song downloads from iTunes valued at $169.
  12. ITunes downloads are valid for 6 months from date of issue.
  13. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  14. Total prize pool value is $54,111. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  15. A draw for any unclaimed prizes may take place on 09.04.2007 at the same time and place as the original draw, subject to any directions from a regulatory authority. Results will be published in The Australian on 18.04.2007.
  16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
    (a) Any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
    (b) Any theft, unauthorised access or third party interference;
    (c) Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    (d) Any variation in prize value to that stated in these Conditions of Entry;
    (e) Any tax liability incurred by a winner or entrant; and/or
    (f) a prize.
  18. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
