HOW TO ENTER
To be eligible to enter, entrants must purchase a specially marked triple-pack of Up & Go from any participating Woolworths or Safeway store between 11/09/06 and 11:59pm AEST on 20/10/06. Entrants must peel off the promotional sticker to reveal if they are an instant winner. Instant winners and non-instant winners can enter the major prize draw by visiting www.upandgo.com.au/movies following the prompts to the competition entry page, inserting the requested details (including unique code and store receipt number) and submitting the fully completed entry form. Instant winners of Hoyts movie tickets and Up&Go product can redeem their prize online. Instant winners of Hoyts Candy Bar upgrade can redeem their prize at Hoyts Candy Bars.
CONDITIONS OF ENTRY
1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.
2. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion and the immediate family of these people are ineligible.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with the entry requirements.
5. Entrants must retain original Woolworths purchase receipt/s for all entries and/or claims as proof of purchase. Failure to produce the proof of purchase for all entries and/or claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.
6. Promotion commences 11/09/06. All claims for instant win prizes must be received by 11:59 AEST on 20/10/06 Entries close for the Major prize draw 11:59 AEST on 20/10/06. The Major prize draw will take place at 15 Barr Street, Balmain NSW 2041 on 25/10/06 at 4pm AEST. The winner of the Major prize will be notified by mail and their name will be published in The Australian on 08/11/06. The Promoter's decision is final and no correspondence will be entered into.
7. Instant win prizes: 17,000 x 1 Hoyts Movie pass valued at $11.00 each, 20,000 x Candy bar upgrade offers valued at $1.00 each, and 34,666 x Up and Go 250ml single pack valued at $2.20 each.
8. The first valid entry drawn in the Major prize draw will be awarded 312 x Hoyts Movie Passes valued at $4,836. This equates to 3 double passes a week for 52 weeks (excluding premium cinemas, LA premiere cinemas and directors suite).
9. Any costs in excess of the (GST inclusive) value of the Hoyts movie tickets and all ancillary costs associated with redeeming the prize are not included and are the responsibility of the winner. If the cost of the prize requested by the winner is less than the value of the Hoyts Movie Tickets, the balance of the value of the Hoyts Movie Tickets will not be awarded as cash.
10. The Promoter shall not be liable if the Hoyts Movie Tickets have been lost, stolen, forged, damaged or tampered with in any way.
11. Redemption of the Hoyts Movie Tickets is subject to any terms and conditions specified on the Hoyts Movie Tickets and to the Hoyts Movie Tickets issuer's standard terms and conditions.
12. Total prize pool value is $288,101.20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash,
13. The Promoter may conduct such further draws at the same time and place as the original Major prize draw as are necessary on 14/02/07 in order to award the Major prize if unclaimed by that date. In the event of any winner their name will be published in The Australian on 21/02/07.
14. If this competition is not capable of running as planned due to any reason whatsoever beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions given by a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
15. Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall render an entry invalid.
16. Printing and other quality control errors will not invalidate an otherwise valid prize claim.
17. Unless otherwise due to fraud or ineligibility under these Conditions of Entry, all prize claims in excess of the advertised prize pool will be honoured.
18. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
19. There will be a total of 215,000 instant win game cards printed for this promotion.
20. To the fullest extent permitted by law, the Promoter excludes all liability (including all liability arising from negligence on the part of the Promoter, its officers, employees or agents), howsoever arising, for: (i) any loss or damage (including any loss of opportunity) whether direct, indirect, special or consequential; or (ii) for personal injury which is suffered or sustained by any entrant; arising in any way out of, in connection with or related to the Promotion, including, but in no way limited to the following:
(a) Any entrant's inability to meet entry requirements;
(b) Any technical difficulties or technical issues whatsoever;
(c) Entries or prize claims that are late, lost, damaged or misdirected prior to their receipt by the Promoter;
(d) Entries or prize claims that are lost or damaged after their receipt by the Promoter due to reasons beyond the reasonable control of the Promoter; and
(e) Any variation in prize value to that which is stated in these conditions of entry.
21. All entries remain the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants' personal information may be disclosed to State and Territory Lottery Departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
